The Smaart Pe Terms and Conditions

These Terms and Conditions govern access to and use of the The Smaart Pe website, merchant dashboard, retailer portal, recharge panel, payment-enabled interfaces, and related B2B assisted digital services. By registering, logging in, or using the platform, you agree to these terms.

1. Service Scope

The Smaart Pe provides a business-oriented digital platform for services such as prepaid mobile recharge, DTH recharge, utility and bill payment support, assisted transactions, retailer operations, and related value-added workflows, subject to service availability, operator rules, partner policies, and compliance checks.

1A. Monthly Recharge Plan Disclosure

Monthly Recharge Plans are not open public products. They are available only to registered and approved users of The Smaart Pe. The purpose of this feature is to help business users, retailers, teams and service partners reduce repeated manual recharge work by allowing eligible selected numbers to be handled through wallet balance and auto recharge settings. Any discount, service margin, promotional benefit or platform benefit is provided by The Smaart Pe only for eligible registered users as a business promotion. It is not guaranteed for every member, visitor or public user.

1B. Auto Recharge Stop or Cancellation

If a user does not want to continue recharge or other services with The Smaart Pe, the user may stop or cancel auto recharge through the available panel option or by contacting support where panel cancellation is not available. Cancellation does not reverse transactions already submitted, pending, successful or under operator or biller processing. Wallet balance, refund and reversal handling will follow the service rules and transaction status.

2. Eligibility and Account Registration

Users must be legally competent and authorized to act on behalf of their business, retail outlet, distributorship, or organization. All registration details, KYC submissions, and operational information must be true, current, and complete. We may approve, suspend, or reject any account at our discretion where risk, mismatch, fraud suspicion, or compliance issues arise.

3. Login and Access Control

Each user is responsible for login credentials, OTP access, and activities carried out through the account. Sharing access with unauthorized persons, using misleading identities, or bypassing security controls is prohibited.

4. Transaction Processing

All recharge, bill payment, and related service requests are processed on a best-effort basis through operators, billers, banks, or aggregators. Successful amount deduction does not always mean final service completion at the same moment because operator-side latency, pending status, reversal cycles, downtime, or API dependency may apply.

5. Pricing, Charges, and Settlement

Service charges, convenience fees, commissions, margins, limits, settlement timelines, and wallet or balance rules may change from time to time. Users are responsible for reviewing the applicable commercial terms visible in the panel or separately communicated by The Smaart Pe.

6. Recharge Accuracy and User Input

The user must verify mobile number, consumer number, operator, circle, amount, and all service identifiers before submission. The Smaart Pe is not responsible for losses caused by incorrect details entered by the user, retailer, staff member, or customer representative.

7. Refunds and Reversals

Refunds, if applicable, depend on the actual operator or biller status, payment confirmation, dispute review, and system logs. Instant refunds are not guaranteed. Pending, failed, reversed, or disputed transactions are handled according to platform records and partner responses.

7A. Payment Gateway Review and Failed Payments

Payments may be authorized, held, failed, reversed or delayed by payment gateways, banks, UPI networks, card networks or partner systems. The Smaart Pe may request proof of payment, transaction IDs or bank statements for reconciliation. Refunds for failed payment gateway transactions are processed according to gateway or bank timelines and may not be instant.

8. Restricted Activities

Users must not engage in unlawful transactions, money laundering, fraudulent recharge attempts, fake onboarding, chargeback abuse, credential sharing, unauthorized automation, data scraping, spam, system probing, or any activity that harms the platform, customers, or partners.

8A. No Public Investment or Guaranteed Return Scheme

The Smaart Pe is a B2B utility, recharge and assisted digital services platform. The platform, wallet, service plan, discount or promotional benefit must not be treated as a public deposit, investment scheme, gambling activity, betting activity, loan product or guaranteed-return financial product. Users must use the platform only for legitimate recharge, utility and business service operations.

9. Suspension and Termination

The Smaart Pe may suspend, limit, hold, investigate, or permanently terminate access if we detect suspicious behavior, policy breach, excessive disputes, fake KYC, operator complaints, legal issues, non-payment, or misuse of the B2B platform.

10. Compliance and Records

Users agree to provide documents, declarations, invoices, tax information, and operational records whenever reasonably required for KYC, AML, audit, reconciliation, or regulatory compliance. Transaction logs maintained by The Smaart Pe will be treated as an important reference for operational review.

11. Intellectual Property

All software, trademarks, branding, layouts, content, workflows, and service materials on the platform remain the property of The Smaart Pe or its licensors. No user may copy, resell, reverse engineer, or commercially exploit the platform except as expressly permitted.

12. Limitation of Liability

To the maximum extent permitted by law, The Smaart Pe will not be liable for indirect, incidental, special, consequential, reputational, or business losses arising from downtime, operator failure, API issues, delayed reversal, force majeure, connectivity failure, user mistakes, or third-party service interruptions.

13. Indemnity

You agree to indemnify and hold The Smaart Pe, its promoters, affiliates, employees, technology partners, and service providers harmless from claims, losses, liabilities, and expenses arising from your misuse of the platform, violation of law, inaccurate data, or breach of these Terms and Conditions.

14. Modification of Services or Terms

We may modify, suspend, replace, or discontinue any service, feature, workflow, or policy at any time. Updated terms become effective when posted on the website or otherwise communicated through the platform.

15. Governing Use

Use of the platform must always remain compliant with applicable law, payment rules, telecom guidelines, and partner instructions relevant to assisted recharge and B2B digital service operations.
